摘要

网络交友打赏型直播诈骗是近年来高发的新型网络侵财犯罪，其将虚假情感关系构建与直播打赏诱导相结合，借助平台分账机制获取违法所得，具有周期长、团伙分工明确、消费属性掩盖诈骗本质、平台角色复杂等特点。本文在界定该类犯罪概念、梳理总体态势与行为类型的基础上，从犯罪主体、被害人、技术、制度监管与法律五个维度剖析其生成机理，进而审视当前治理的成效与困境，并从完善刑事司法认定规则、构建全链条平台责任体系、健全被害人救济机制、搭建全链条协同治理体系四个方面提出治理路径优化建议，以期为新型网络诈骗行为的法律应对提供理论支持与实践指导。

Abstract

Online dating reward-based livestream fraud is a new type of cyber fraud with a high incidence in recent years. It combines fabricated emotional relationships with livestream tipping inducement and obtains illegal gains through the platform's revenue-sharing mechanism, characterized by long cycles, well-divided gang division of labor, consumption attributes concealing the nature of fraud, and complex platform roles. Based on defining the concept of such crime and reviewing its overall trend and behavioral types, this paper analyzes the generation mechanism from five dimensions of criminal subjects, victims, technology, institutional supervision and law, and then examines the achievements and difficulties of current governance. On this basis, it proposes optimization paths from four aspects: improving criminal judicial determination rules, constructing a full-chain platform responsibility system, improving victim relief mechanisms, and establishing a full-chain collaborative governance system, so as to provide theoretical support and practical guidance for the legal response to new types of cyber fraud.
