数字政府建设中,政务数据共享是提升治理能力的关键路径。然而,共享过程中难免发生错误,当错误数据影响公民权益时,由于数据更正的法定职责问题现行制度尚不明确,导致难以顺利更正错误。本文以周某诉南京市溧水区民政局、南京市民政局不履行行政登记职责及行政复议案为切入点,分析政务数据共享中职责归属不清、数据质量欠佳、救济渠道不畅三重困境。政务数据更正责任的模糊性来源于数据共享过程涉及的多个部门之间责任边界尚未厘清,数据质量保障机制缺失,公民申请更正的程序性权利缺乏制度支撑。为此,应从明确职责归属、提升数据质量、完善履职标准、拓宽救济渠道四个维度构建系统化的数据更正制度,将内部问责机制作为责任追究的终点。

In the process of digital government construction, government data sharing has become a key pathway to enhancing governance capacity. However, errors inevitably occur during data sharing. When such errors adversely affect citizens' rights and interests, the existing legal framework fails to clearly define the statutory duties for data correction, making it difficult to rectify such errors smoothly. Taking the case of Zhou v. Nanjing Lishui Civil Affairs Bureau and Nanjing Civil Affairs Bureau for Failure to Perform Administrative Registration Duties and Administrative Reconsideration as the point of entry, this article analyzes three intertwined dilemmas in government data sharing: ambiguous attribution of responsibilities, inadequate data quality, and ineffective remedy channels. The ambiguity of responsibility for data correction stems from unclear boundaries among multiple departments involved in the data-sharing process, the absence of data quality assurance mechanisms, and the lack of institutional support for citizens' procedural rights to request corrections. To address these issues, a systematic data correction regime should be constructed along four dimensions: clarifying responsibility attribution, improving data quality, refining performance standards, and expanding remedy channels, with internal accountability mechanisms serving as the ultimate point of liability pursuit.
